Circuit Judge Terry Dempsey set formal sentencing for Oct. 1.
Waldrop was convicted of killing 3-week-old Jodey Jo "Chance" Waldrop on Sept. 22, 2005. Prosecutors contend that Jodey Waldrop slammed the child against something or shook him during a 20- to 30-minute period when he was home alone with the infant, who died three days later at Children's Hospital in Birmingham.
