A mentally retarded man will be removed from death row after Gov. Mike Foster agreed to change his sentence to life in prison. A recommendation from the state's Pardon Board earlier this week said Herbert Welcome should be taken off death row because of a June 2002 U.S. Supreme Court decision calling the execution of mentally retarded people "cruel and unusual punishment." The governor signed off on the recommendation Friday. Welcome, 51, was sentenced to death in 1982 for the 1981 murder of his aunt and her boyfriend. Welcome, who has spent 19 years on death row. Experts estimate Welcome has the mental maturity of an 8-year-old.
