A post-conviction DNA testing bill (SB 172) was introduced in the Utah Senate by Sen. Lyle Hillyard, R-Logan, at the request of prosecuting attorneys. He said that as technology improves, there will be more cases of DNA exonerations, and Hillyard wants to make sure the courts aren't left guessing how to address the cases. The wording of the legislation has not been filed. Hillyard, a lawyer, said he wants to talk to defense attorneys about the bill before continuing. He said the current proposal is too restrictive because it doesn't consider cases where an innocent person might have pleaded guilty to avoid the death penalty.
