Amina had borne a child outside marriage. And although she had been divorced for some years the mandatory punishment under Islamic law is death by stoning. On learning of the postponement till August 27th of Amina Lawal’s trial, Sergio d’Elia, Secretary of Hands Off Cain declared:
“Its news which we were expecting and which reveals the difficulties faced by a state such as Katsina, which has introduced Sharia law, in making provisions for the execution by stoning in the abolitionist President Olusegun Obasanjo’s Nigeria.
“Today’s decision is another step towards the final solution to both the problem and the case, that is to say Amina’s acquittal in Katsina or a declaration indicating as unconstitutional the application of Islamic penal law in President Obasanjo’s secular Nigeria.”
