Belgium abolished the death penalty for all crimes in 1996.
The last execution was carried out in 1950. On June 23, 2003 Belgium deposited with the Council of Europe the instrument of ratification of Protocol No 13 to the European Convention on Human Rights and Fundamental Freedoms banning the death penalty in all circumstances.

On 29 September 2017, Belgium voted in favor of the resolution on the death penalty (L6/17) at the UN Council on Human Rights.
On 16 December 2020, as in previous years, Belgium co-sponsored and voted in favour of the Resolution on a Moratorium on the Use of the Death Penalty at the UN General Assembly.
