David Gatton, charged with fatally shooting Anthony Henson in a Brooklyn, Md., apartment in February, sought asylum in Canada in June. Gatton said he was entitled to asylum under international law because he could face the death penalty in Maryland. Canada, which banned the death penalty in 1976, does not require judges to deport fugitives who face the death penalty. A Baltimore prosecutor and homicide detective traveled to Vancouver on July 7 to assure Canadian officials that the Gatton case does not fit the profile of a typical death penalty case. But Gatton has also claimed that being placed in Maryland's overcrowded prisons would be a form of persecution.
