During a press briefing by the EU Commission, spokesman Leonello Gabrici said there would be no question of extraditing to third countries persons who could face the death penalty.
He added that there was as yet no EU-wide law on extradition and therefore bilateral agreements between EU countries and the United States would prevail in such a situation. He stressed that it would be up to the national authorities to react if Osama din Laden was arrested in their country.
Gabrici added that Justice and Home Affairs Commissioner Antonio Vitorino and the Commission had earlier stated they were against death penalty and that this would be a sufficient argument to refuse extradition.
