In a 5-2 ruling the Ohio Supreme Court ordered a new trial for James Were, 44, sentenced to death for strangling Robert Vallandingham, a guard held hostage during a 1993 11-day riot at the Southern Ohio Correctional Facility.
The court found that Visiting Judge Donald Cox, of Columbus, erred when he disregarded repeated requests by Were's lawyers for a competency hearing after their client refused to cooperate and displayed paranoid behaviour.
