In a significant ruling, Pakistan's Sindh Provincial High Court set aside the death sentence given [on February 17, 2001] to two activists of the Muttahida Qaumi Movement (MQM) by an anti-terrorism court for allegedly working for Indian intelligence.
The two member appellant bench of the High Court acquitted Muhammad Shafique alias Pappu and Abdul Jabbar alias Zafar of charges of being agents of the Research and Analysis Wing (RAW).
Stating that the evidence produced by the prosecution was too inadequate and defective to prove any one guilty, the High Court said that the allegations of recovery of weapons and explosive substances by the police from the possession of the accused had not been proved beyond reasonable doubt.
The bench also suggested amendments in the Anti-Terrorism Act with regard to the recording of confessional statements which, in a majority of cases, were denied at the trial level.
