In Hayward, a prosecutor spared the life of Ruben Eliceo Vasquez, 27, saying he will not retry him for the 1998 shooting of Alameda County Sheriff's Deputy John Paul Monego. "We have decided not to further pursue the death penalty in this case," Jon Goodfellow of the Alameda County District Attorney's Office told Hayward Superior Court Judge Alfred Delucchi. Ruben Eliceo Vasquez, 27, was convicted last month of killing Monego, 33, in December 1998. During the penalty phase of the trial, the jury split 6-6 on whether to sentence Vasquez to death, and Delucchi declared a mistrial.
