In San Francisco, ruling 4-3, the California Supreme Court overturned the death sentence of James Heard, 50, a child killer, ruling that the trial judge improperly conducted jury selection. The court, however, upheld James Heard's conviction for brutally murdering and sexually assaulting Katrina Brown, his girlfriend's 14-year-old daughter - meaning his death sentence was changed to life without parole. But it also ordered a new jury to determine whether Heard should live or die for the 1990 killing. The case is People v. Heard, S035769.
