In Windsor, a Bertie County judge threw out the 1998 murder conviction of death row inmate Alan Gell and ordered a new trial

In Windsor, a Bertie County judge threw out the 1998 murder conviction of death row inmate Alan Gell and ordered a new trial.
Superior Court Judge Cy A. Grant Sr. faulted the state for withholding evidence that he said could have been used to prove Gell's innocence at his trial.
Gell was found guilty of the April 1995 slaying of Allen Ray Jenkins, 56. In custody since August 1995, Gell, now 28, has always maintained his innocence.
The attorney general has 60 days to appeal Grant's ruling to the state Supreme Court.
