In yet another what's-in-a-name mix-up, the President of the Philippines was all set to send two convicts to the death chamber when, as it turned out, they were not the ones scheduled for execution.
The Bureau of Corrections had to be corrected by the secretary of justice, but only after the names of the wrong men had been announced. Because of that mistake or not because of it, the justice secretary said the name -the correct name- of the convict, not two but one, who is doomed to die on October 16 should not be published "to avoid unnecessary anxiety."
Unnecessary anxiety was what happened to the two convicts wrongly identified and their families.
Unfortunately for them, do they have the means to sue the director of the Bureau of Corrections for cruel and unusual punishment?
As this mix-up shows, under our penal system a man can be sent to his death without knowing that his time is not yet up. His name is revealed to the highest authority, the person who has the power to commute his sentence, pardon him, or delay his date with death, the very same person who will not save him or do anything to stop the lethal injection. And still the disclosure of that man's identity can be taken so lightly by the prisons chief?
Then again, why not? Death row is packed to the rafters. What's one less rapist, one less murderer, one less kidnapper, one less drug lord?
Speaking of which, the prisons director's mistakes don't end there. There's been another one. The convict singled out for execution in October-he'll be the first to be sent off by this administration-is a rapist, not a kidnapper. This is confusing, because in her talk with Malacanang reporters (during which she revealed the names of the two candidates for execution), the President said she was bent on executing -no reprieve, no mercy- kidnappers and drug traffickers, the kind of scum that she wants to dispose of, using a "legal weapon of the state" to protect its citizens and as a deterrent to the commission of crime. She did not mention rapists as being on top of her hit list.
Wrong men, wrong names, wrong crime. How many more mistakes is the prisons director not telling us about? Pray tell, have some of his mistakes sent the wrong men to the wrong destinations?
