it was in May 1999 when Nathan Herring and Terrell Yarbrough allegedly kidnapped and murdered 2 university students. But because the murders happened in Pennsylvania, the Ohio Supreme Court overturned Yarbrough's murder convictions, saying there was no jurisdiction to prosecute in Ohio (see Dec. 1, 2004).
Now, Herring's murder convictions have been thrown out in Ohio, based on the ruling in the Yarbrough case.
Jefferson County court threw out the murder convictions against Herring, but upheld the convictions on all other charges against him, which include kidnapping, receiving stolen property, and weapons charges.
This ruling does not mean Herring will be released from jail, as he's still serving 65 years on non-homicide charges.
Like Yarbrough, Herring can now be charged and tried in Washington County, Pa., for the murders of Aaron Land and Brian Muha. If a jury convicts him, he runs the risk of receiving the death penalty.
