ITALY. TRIBUNAL RULES AGAINST EXTRADITION OF CIPRIANI TO CONNECTICUT

the Regional Administrative Tribunal (TAR) of Latina, Italy, suspended the extradition to the United States of Benedetto Cipriani, an Italian-American national charged with killing three people in the US. Italian Justice Minister Castelli had given permission to the US-requested extradition paving the way for Cipriani’s transfer to Connecticut, where the death penalty is in force.
Lawyers for the suspected murderer brought the Minister’s decision to the Regional Tribunal following which two ruling were urgently emitted blocking the extradition due to insufficient guarantees that the defendant would not be sentenced to death. 
The move was a temporary safeguard in anticipation of a definitive ruling.
Italian law is one of the toughest with regards to extradition. Nobody may be extradited to a country with the death penalty unless that country provides ‘absolute certain’ guarantees that capital punishment will not be applied to the case in question.
