Judge orders new sentencing hearing for death-row inmate. A death-row prisoner should get a new sentencing hearing because jurors didn't hear enough about the defendant's brain injury, a judge in Forsyth County ruled. Superior Court Judge Lindsay Davis agreed that attorneys for Danny Dean Frogge didn't present enough evidence about possible brain damage that Frogge suffered during a bar fight in 1990. Frogge, 40, was sentenced to death for the slaying of his stepmother, Audrey, and to life in prison for the death of his father, Robert. Frogge was convicted in 1995, but the state Supreme Court granted a new trial because tainted evidence was allowed into the 1st trial. Frogge was again convicted in 1998. His attorneys for both of those trials, David Freedman and Danny Ferguson, presented mitigating evidence about years of physical, verbal and sexual abuse he suffered at the hands of his father.
