In Kenya, two men were sentenced to death for robbery with violence in Mt Elgon district.
This comes despite many constitutional lawyers' argument that the new constitution does not provide for the sentence.
Vincent Kasuti and Anthony Werunga were sentenced to hang at the Bungoma law courts by magistrate Francis Kyambia. The two were found guilty of violently robbing and killing Job Wakholi at Chepkube village on November 10, 2008 before making away with his Sh90,000 motorcycle.
Prosecutor Wako Abdul had testified that Kasuti and Werunga boarded Wakholi's boda boda heading to the Malaba border, claiming they were going to Uganda for business but killed him on the way and dragged the body to River Luakhakha. Wakholi's jacket was found at River Luakhakha by his family and friends who had been looking for him for five days. They notified the police who retrieved his mutilated body from the river after a search.
Inspector Abdul lined up 14 witnesses who gave an account of what happened. Wakholi's wife said she saw him carrying Kasuti on the day he disappeared. While making the ruling kiyambia said the prosecution had proved beyond reasonable doubt that the accused participated in the death of the deceased and had option to give the harshest penalty.
