The Constitution of October 17, 1868, as amended on April 29, 1999 states at Art. 18 that: "The death penalty cannot be established." The last execution was carried out in 1949. Luxembourg co-sponsored the resolution on the death penalty approved by the UN Commission on Human Rights on April 20, 2005. The resolution was introduced by Luxembourg holding the EU Presidency. The resolution get 81 co sponsors and was approved with 26 votes in favour, 17 against and 10 abstentions.
