MALAYSIA: APPEALS COURT UPHOLDS DEATH SENTENCE ON SWEDISH NATIONAL FOR DRUG TRAFFICKING

The Court of Appeal in Putrajaya upheld the conviction and death sentence of a Swedish national for trafficking in 4.3 kilogrammes of methamphetamine.
The panel, comprising Justices Datuk Wira Mohtaruddin Baki, Datuk Tengku Maimun Tuan Mat and Datuk Seri Zakaria Sam, unanimously dismissed Ferry Linnbark's appeal.
When handing down the decision, Justice Mohtaruddin said after considering the evidence in totality, the court found that there was sufficient mens rea (intention or knowledge) to infer possession of the drug.
He ruled that Linnbark's conviction was safe and upheld the High Court's decision in finding him (Linnbark) guilty on the drug trafficking charge and sentenced him to death.
Linnbark, 46, who owns a pub in Pattaya, Thailand, was found guilty and sentenced to death by the High Court in Shah Alam on April 23, 2012 of committing the offence at the passenger inspection division in the international arrival hall of the Kuala Lumpur International Airport in Sepang at 10 am on Dec 6, 2011.
Linnbark has one final step to appeal against the appellate's decision, which is to the Federal Court.
