Media Cannot Watch Executions in Arkansas, According to Ruling In Little Rock, a federal judge has ruled the First Amendment provides no guarantee that witnesses should be able to see every step of an execution in Arkansas.
U.S. District Court Judge Susan Webber Wright rejected the claims of the Northwest Arkansas Chapter of the Society of Professional Journalists, the Arkansas Times and Arkansas Times editor Max Brantley. In her ruling, Wright noted executions have "moved from the public square to inside prison walls," an area where the U.S. Supreme Court has ruled reporters have no special right to access.
Currently, media and public witnesses cannot watch as intravenous tubes are inserted into and removed from the inmates. Curtains to the execution chamber open to witnesses after the condemned prisoner is already strapped to the gurney, and close once the inmate is dead.
Brantley says those procedures, especially the insertion of the IV, are moments that journalists should witness as public watchdogs.
