Montana does not forbid the execution of the mentally retarded but does forbid the execution of juvenile offenders. The state has life without parole. A judge decides the sentence. The Governor has the power to grant clemency with the advice of the Board of Pardons. The Governor must have a favorable recommendation to grant clemency. However, the Governor is not bound by that recommendation.
