On October 5, Lobatse High Court Judge, Dudley Reynolds, upheld Ditshwanelo's application to temporarily suspend the execution of the two convicts after listening for two days to arguments on the possibility of mistrial by both the defense attorneys and the Attorney General, Phandu Skelemani, pending the Court's ruling on the possible mistrial of the two death row convicts. Leading the defense arguments on the second leg of the case which focused on the possibility of mistrial, Advocate Brian Spilg, charged that the defense counsel who was handling the case on behalf of the condemned men on a pro deo basis did a poor job by failing to consult with his clients. "Failure to consult should be considered an irregularity because the attorney failed to meet the test that is required in his profession," he said. Spilg added that during the trial no interpretation was made in the language which was understood by the accused persons.
