Pakistani lawyers dealing with cases under the Offence of Zina (Enforcement of Hudood) Ordinance, 1979, under which Zafran Bibi was condemned to death by stoning by the trial court in Kohat, claimed that under this law the punishment cannot be enforced once the defendant files an appeal before the federal Sharia Court and retracts her confessional statement.
Lawyer Noor Alam Khan, chairman of Voice of Prisoners, Free Legal Aid Cell, said that under sub-section 3 of section 9, the court may order a retrial if the convict retracted his or her statement.
