The 8th U.S. Circuit Court of Appeals reinstated the death sentence of Carey Dean Moore.
The 7-6 ruling narrowly reversed a decision last year by a 3-judge panel of the same court, which voted 2-1 to overturn Moore's death sentence.
At issue was whether the definition of "exceptional depravity" in Nebraska law and its use to justify the death penalty was unconstitutionally vague.
Moore, 45, was sentenced to death in 1980 for the murders the year before of Omaha cab drivers Reuel Van Ness Jr. and Maynard Helegland during 2 robberies.
