the Court of Criminal Appeals ordered a new trial for Glen Dale Gore because he was not allowed to present evidence that others might have committed the crime.
Gore was convicted and sentenced to death in 2003 for killing Debra Sue Carter, 21. She was raped and strangled in 1982.
Subsequent DNA testing of Gore showed his sperm was found on the victim, the Court of Criminal Appeals said.
Gore claimed that the trial judge's ruling that he couldn't submit evidence that others might have committed the crime denied him due process and the right to put on a defense.
