The Delaware Supreme Court has overturned the death sentences given 2 men in 1997 after finding an appearance of unfairness by the judge who presided over their murder trials

The Delaware Supreme Court has overturned the death sentences given 2 men in 1997 after finding an appearance of unfairness by the judge who presided over their murder trials.The 5-judge court in a unanimous decision said retired Superior Court Judge Norman A. Barron had asked to handle the case even before the men were indicted and said it was obvious Barron "harbored strong feelings" about the murder. A jury convicted friends David Stevenson and Michael Manley, both 26, of killing (on Nov. 13, 1995)a security guard on the day the guard was to testify against Stevenson in a theft case. The Supreme Court did not find that Barron acted improperly. It found the appearance of unfairness was enough to overturn the death sentences.
