The law on capital punishment, as passed by Parliament, is yet to be carried out "to the fullest".
The death sentence has been pronounced twice since the law was passed about a decade ago but has not been enforced in either case, judicial staff said. They affirmed the situation after a report in the Post-Courier on March 8 said that an Oro man was sentenced to death but that his punishment was reduced on appeal.
However judicial officers said that Charles Ombusu was later found not guilty, on appeal.
"He was found not guilty on the grounds of self-defence," an officer said. "Ombusu and the other man both rushed with their weapons to a path and faced each other with guns pointed, it was a matter of which one fired first," he said.
Ombusu was then sent for trial on the charge of rape, a crime that had lead to the shooting and wilful murder trial. He was found guilty and sentenced to a term in prison for the rape.
