The state Supreme Court has ordered a new sentencing hearing for Jeffery Haselden, who was sentenced to die for killing his 2-year-old son, Joshua. on May 12, 1999.
The justices said in their decision that jurors should have been given more instruction in the 2001 trial.
The court said jurors should have been told that a life prison sentence carries no chance of parole.
Jurors had asked for the instruction during the penalty phase, but Circuit Judge Gary Clary refused their request.
