the Tanzanian Court of Appeal confirmed the death sentence passed on Mrisho Nguvila of Iringa for killing his brother over the inheritance of their late father's property. Justices Damian Lubuva, Mbarouk Mbarouk and Chande Othman, dismissed in its entirety the appeal by Nguvila as it lacked legal merit. In his appeal, Nguvila argued that the judgment dated April 4, 2007, by High Court Judge Frederick Werema, ignored the fact that he was insane at the time he committed the offence. However, the Appeal Court justices observed that the appellant walked for about six kilometers to kill his brother meaning that he had premeditated his action. "We have no doubt that the trial judge had fully addressed all the evidence including the appellant's alleged insanity," the justices ruled. On February 11, 2003, the appellant is said to have killed his bother, Ailon Nguvila, at Mejegele Village where he was grazing cattle. Mrisho attacked Ailon using an axe, before dumping his body the into a river.
