The extradition accord concerns the extradition of those sentenced to death, among other things. Where the crime of the person wanted for extradition can attract the death penalty in the requesting country but not in the country receiving the request, the state can allow the extradition on the condition that the death penalty will not be applied.
If the requesting state accepts the treaty’s condition, it must be respected. If the state does not accept the requested condition, the extradition can be refused.
