The Court asked the 11th U.S. Circuit Court of Appeals to reconsider its ruling against John W. Hightower, who was sentenced to death for the 1987 killing of his wife and 2 stepdaughters.
Hightower, 61, who is black, claimed in the appeal of his death sentence that prosecutors improperly struck blacks from the jury.
Hightower was tried in Morgan County in 1988 on a change of venue.
