U.S. District Judge Tim Leonard has overturned the conviction and death penalty of Tyrone Darks, found guilty in 1995 of murdering his ex-wife

U.S. District Judge Tim Leonard has overturned the conviction and death penalty of Tyrone Darks, found guilty in 1995 of murdering his ex-wife. Judge Tim Leonard ruled Tyrone Darks did not receive a fair trial because of "numerous errors." Darks, 36, was found guilty and given the death penalty by a Cleveland County jury for the 1994 slaying of his former wife, Sherry Goodlow, 26. Leonard ruled Darks was entitled to a new trial because the jury was not given the option of finding him guilty of manslaughter instead of murder. There is evidence Darks may have acted in the "heat of passion" and the slaying was not premeditated, the judge said.
