The Alabama Supreme Court has unanimously upheld the constitutionality of the state's death penalty statute against a challenge that its judicial sentencing provisions violate the Sixth Amendment right to a jury determination of all facts necessary to impose the death penalty. The ruling came in the case of Jerry Bohannon v. State. (see also 09/01/2014, 12/01/2016, 03/03/2016 and 17/06/2016).
