The U.S. Supreme Court has reinstated the death sentence for Edward Schad. Schad, who will be 71 in July, White, was sentenced to death in the August 1, 1978 murder of Lorimer "Leroy" Grove, 74. He was convicted in October 1979, but the conviction was overturned on the grounds that the trial judge improperly instructed the jury. He was convicted of first-degree murder and sentenced to death again in a 1985 retrial. The justices' action overturned the 2009 decision by the 9th U.S. Circuit Court of Appeals in San Francisco over technicalities. The court says in an unsigned opinion that the 9th U.S. Circuit Court of Appeals must step away from Schad's case and allow the state to proceed.
