Timothy Howard, 44, Black, on death row for killing a White couple on December 13, 1997 is getting a new trial. Howard was convicted in 1999 of shooting Brian Day and strangling his wife Shannon. Howard appealed his conviction, there were too many questions about the evidence and how it was handled at the time of the trial. Little River County Circuit Judge Charles Yeargan granted Howard a new trial, citing several problems with the DNA tests. There were also missing computer records. A conviction on a capital murder charge with the death penalty at stake requires a unanimous jury.
