The 9th U.S. Circuit Court of Appeals overturned the death penalty for Kenneth Clair, citing incompetence by his defense attorney. Clair, 57, Black, was convicted for the 1984 rape and murder of Linda Faye Rodgers, and sentenced to death in 1987. Because the San Quentin inmate in question has suffered "disturbing sexual abuse," his habeas petition was filed under seal.
