Florida Supreme Court orders 5-2 new hearing for Eddie Wayne Davis. Davis, 45, White, is currently scheduled to be executed on July 10 for the March 3, 1994 rape and murder of 11-year-old Kimberly Waters, his girlfriend's daughter. He was sentenced to death on June 30, 1995. The Florida Supreme Court ordered a circuit court in Polk County to hold a hearing on whether it would be unconstitutional to use a lethal injection drug on Davis. Davis maintains that he suffers from the medical condition porphyria and that use of the first drug administered during lethal injection will cause him extreme abdominal pain, nausea and vomiting.
