Gov. Rick Scott has scheduled the execution of Manuel Valle for a 3rd time. Valle is set to be executed by lethal injection at 4 p.m. Sept. 28. Scott initially signed Valle’s death warrant — the governor’s first — for Aug. 2. The Florida Supreme Court temporarily delayed the execution and, after holding a hearing on the new use of a drug in lethal injections, allowed it to move forward. The governor rescheduled the execution for Sept. 6. Valle then received another short stay, this time from a federal appeals court in Atlanta that wanted to examine his claim that he should have received a clemency hearing. That court ruled against Valle and lifted the stay last week. He still has a case in Jacksonville federal court and an appeal pending before the U.S. Supreme Court. Valle was convicted of fatally shooting 41-year-old police officer Luis Pena during a traffic stop in April 1978. Valle was driving a stolen car when he was stopped by Pena and officer Gary Spell, who also was shot but saved by his bulletproof vest.
