The Court issued an order, citing Hurst, vacating the death sentence and remanding to the circuit court for a new penalty phase to Smith because he had been sentenced to death for two counts of murder based on jury votes of 10-2 and 9-3. On March 17, 2005, Smith received two sentences of life in prison for his involvement in the murders of Jackie Pope and Leon Hadley.
