USA - Florida. The state Supreme Court vacated the death sentence of James Guzman because it was not unanimous

The Florida Supreme Court unanimously upheld the 1st-degree murder conviction of James Guzman but vacated the death sentence because a jury was not unanimous in recommending the death penalty. Guzman, now 53, Hispanic, was arrested in the Aug. 10, 1991 slaying of David Colvin, 48, as part of a robbery. He was sentenced three times. Also the previous 2 convictions and sentences have been overturned on appeal. In Guzman's third sentence, the jury in Volusia County recommended the death penalty in an 11-1 vote (see May 3, 2016). The ruling, like numerous others in recent months, was rooted in a 2016 U.S. Supreme Court opinion in a case known as Hurst v. Florida and a subsequent Florida Supreme Court decision.
