The 11th U.S. Circuit Court of Appeals in Atlanta threw out the death sentence impose against Eric Lynn Ferrell. In a unanimous ruling, the 3-judge panel of the 11th U.S. Circuit Court of Appeals found that Ferrell's lawyers at trial were ineffective because they failed to present jurors "very significant" mitigation evidence on their client's behalf. Ferrell is now entitled to another sentencing trial. The ruling said jurors were not told that Ferrell suffered from extensive, disabling mental health problems and diseases, such as organic brain damage to the frontal lobe, bipolar disorder and epilepsy. Ferrell was foun guilty of killing his grandmother (Willie Myrt Lowe, 72) and 15-year-old cousin (Tony Kilgore) on Dec. 30, 1987.
