Teddy Chester, who won a new trial in June as a result his trial lawyer's ineffectiveness for failing to challenge the prosecution's case—including DNA evidence that showed it was highly unlikely that he was the killer—will not face the death penalty in his retrial in Louisiana. The grand jury convened to consider charges against Chester indicted him only on the non-capital charge of second-degree murder. Chester continues to maintain his innocence.
