The House killed an amendment reinstating the death penalty. Rep. James R. Miceli, Democrat, introduced the bill this month as an amendment to the state budget before the marathon bombings. Members of the Democratic House leadership objected to the death-penalty measure being attached to the budget and House members instead supported an amendment by Rep. Eugene O'Flaherty to study the cost of bringing back capital punishment, which effectively killed the death-penalty legislation. Miceli's amendment was effectively defeated when the House, by a 119-38 vote, agreed to a substitute amendment offered by Representative Eugene O'Flaherty, Democrat, calling for a full study of the measure's impact on the judicial system. The amendment, filed before the Boston tragedy that killed three people and injured more than 260, would have imposed the death penalty for murders of public officials, including police, firefighters, and corrections officers. Miceli said he has introduced the same legislation several times, and filed the most recent budget amendment 3 days before the marathon bombings.
