U.S. District Court Judge Terrence Boyle ordered that Elmer Ray McNeill, now 38, be sent back to a Wake County courtroom to be resentenced for the 2 counts of 1st-degree murder he was convicted of. On the night of Sept. 19, 1993, John Ray, 27, and Mike Truelove, 20, were killed and robbed of nearly $2,800. McNeill's 1995 trial lawyers didn't seek out enough evidence about the suspect's childhood and prior bouts of depression, Boyle ruled. That evidence could have been used by the jury in their decisions between deciding life and death punishments. McNeill's brother, Robert McNeill, is serving a life sentence without parole.
