David Ramtahal, 29, Black, freed from death row in teen's murder. Ramtahal will leave death row after reaching a rare agreement with the Bucks County District Attorney's Office that will change his sentence to life in prison without parole for killing a man in 2006. A jury in 2009 sentenced Ramtahal to death for the Nov. 15, 2006 murder of Jarrett Osborne. Ramtahal was back in county court in Doylestown Thursday for a Post Conviction Relief Act hearing. The hearing was halted after the agreement was announced. Deputy district attorney Robert James said the decision was made after Ramtahal's attorney from the Federal Defender's Office, Billy Nolas, presented evidence that was not available to the jury that handed down the death sentence. Nolas was prepared to put experts on the stand who would testify that Ramtahal suffered possible brain damage and Post Traumatic Stress Disorder related to abuse he suffered as a child, both in the United States and his native country of Trinidad. The appellate lawyers traveled to Trinidad to get information that wasn't available to Ramtahal's court-appointed attorney, Ronald Elgart, at the time of the trial. "It's a legal issue," James said. "I still think he deserved the death penalty, but the law requires effective counsel in respect to researching mitigating evidence. There was a lot that the jury did not see." James said that Osborne's relatives had also expressed their desire that Ramtahal's death sentence be changed to life. County Judge Alan Rubenstein accepted the agreement, which required Ramtahal to agree to the prosecution's version of the crime and waive all current and future appeals. Ramtahal will serve the sentence consecutive to a life sentence he was already serving for an unrelated 2007 Montgomery county murder.
