The state Supreme Court has overturned the death penalty of Gaylord Spell, 48, black, convicted in the 2007 bludgeoning murder of a woman, saying there wasn't enough evidence the man tortured the victim. The court has upheld the 1st-degree murder conviction of Spell, which means he'll spend life in prison. Spell was convicted in 2008 after DNA linked him to the killing of 40-year-old SueAnn Brest, whose nude, battered body was dumped in a parking lot on March 1, 2007. Lawrence County prosecutors argued she was tortured, making Spell eligible for execution, because of the numerous blows inflicted with a blunt object. But the high court says torture wasn't proven because prosecutors couldn't say for sure at what point during the attack Brest died.
