Jimmie Lucero gets life in prison. He won't be eligible for parole for 40 years. Lucero, 53, hispanic, waived the right to further appeals. That judgment comes after his death sentence was overturned on September 16 (see). District Attorney Randall Sims said that the victims’ family didn't want to go through the trial process again, and they are okay with the new judgment. Sims said that Lucero is 53 meaning he will be 93 before he would be eligible for parole. On September 16, the Court of Criminal Appeals threw out Lucero's death sentence. The state's highest criminal court agreed with attorney's representing Lucero, that his trial lawyers did a poor job of investigating his background and presenting mitigating evidence to a jury that decided on May 25, 2005 (see) that he should die. Lucero was convicted in the Sept. 6, 2003, slayings of 71-year-old Pedro Robledo, his 72-year-old wife, Maria, and their 31-year-old daughter, Fabiana.
