In 2002 Wolfe had been sentenced to death

Justin Michael Wolfe has been released. His release took place on 28 September 2026, after a judge in Virginia quashed his murder conviction and Wolfe accepted a plea deal on minor offences, with the sentence equalling the time he had already served.

In 2002, Wolfe had been sentenced to death on charges of having instructed a friend to murder a cannabis dealer, Daniel Petrole, to whom he owed money. The murder took place on 15 March 2001.

Owen Barber had testified against him, confessing that he had shot Petrole himself; in exchange for this testimony, he received a 38-year sentence.

Barber, who was the only witness linking him to the crime, subsequently retracted his testimony, claiming he had been threatened with the death penalty.

On 12 July 2011 (see), Federal Judge Raymond A. Jackson had quashed the guilty verdict due to a series of extremely serious irregularities that suggested Wolfe might have been ‘framed’. Wolfe, however, remained in custody pending a retrial.

Fifteen years of appeals by the prosecution have led to the confirmation of the 2011 ruling overturning the guilty verdict, and to the confirmation of “decades of serious irregularities: concealed evidence, manipulated testimony, procedural errors”. 

In September 2026, Judge Carl Weimer definitively quashed the murder conviction.

Wolfe accepted a plea deal with the prosecution. The prosecution withdrew the original murder charge and asked him to accept a conviction for dealing marijuana and incitement to robbery, along with a sentence “equivalent to the time already served”.

This latest decision was made as part of a plea bargain known as an ‘Alford plea’, which means that the defendant does not admit guilt but acknowledges that the prosecution has sufficient evidence that could lead to a conviction.

It is a compromise: when the prosecution knows it has little evidence to secure a new conviction, it offers as part of the deal the prospect that it could still delay the defendant’s release by further appealing the acquittals. The defendant knows that, by persisting, he could secure a full acquittal, but this could keep him in prison for several more years. The agreement consists of the prosecution consenting to immediate release, but in return ensuring that it is not completely discredited.

Wolfe was released from Prince William County Jail on the evening of 28 September 2026.

Wolfe is free, after spending 25 years in prison, including over 10 on death row. The murder charges have been formally dropped.
