The U.S. Court of Appeals for the Fourth Circuit has affirmed a Virginia district court ruling that had declared the Commonwealth's death-row conditions of confinement unconstitutional. Virginia had voluntarily implemented reforms in response to a lawsuit filed by death-row prisoners, but had refused to rule out reinstituting those conditions in the future. The court's action bars state officials from reimplementing the unconstitutional conditions.
