William Coday, sentenced to death on July 26, 2002 (see) for killing his ex-girlfriend, will have another chance at avoiding the death penalty.
The Florida Supreme Court upheld William Coday's guilty conviction but overturned his death sentence.
In a 5-2 decision, the majority faulted Broward Circuit Judge Alfred J. Horowitz for rejecting testimony from 6 experts who said Coday suffered from ''borderline personality disorder'' -- depression, psychotic episodes and other mental problems. Coday, who is now 49, was convicted of killing Gloria Gomez, 29, on July 11, 1997. Coday's jury voted 9-3 for death.
It was not the 1st time Coday had killed. In 1978, Coday was convicted in Germany of killing Lisa Hullinger. He was released after serving less than 1/2 of a 3-year sentence, a reduced penalty due to his psychiatric problems. Jurors who recommended the death sentence in the Broward case were not told of the previous killing.
